4. Termination of employment
Either party can terminate this agreement with four weeks written notice. In the case where an employee is illiterate notice may be given by that employee verbally.

An employee, who is parent of a child is entitled at least ten consecutive days’ Parental leave, when the employee’s child is born, or adoption is granted, or the child is placed in the care of the prospective adoptive parent by a competent court, pending finalization of an adoption order.

ADOPTION LEAVE

An employee is an adoptive parent of a child who is below the age of two years and is entitled to at least ten weeks’ consecutive adoptive leave: or ten consecutive days’ parental leave when adoptive is granted, or the child is placed in his/her care as prospective adoptive parent by a competent court, pending finalization of an adoptive order.

COMMISSIONING PARENTAL LEAVE

An employee, who is a commissioning parent in a surrogate motherhood agreement is entitled to at least ten consecutive weeks commissioning parental leave when the child is born as a result of surrogate motherhood agreement. The employee will not be entitled to remuneration during his / her parental (paternity), adoption or commissioning parental leave period, but may claim paternity / adoption or commissioning parental leave benefits as laid down in the provisions of the Unemployment Insurance Act,
7. Meal Intervals
The employee agrees to a lunch break of 60 minutes. Lunchtime will be taken as per department lunch roster. The meal interval of 60 minutes per shift will be unpaid.

8. Public Holidays
If the employee is required to work on a public holiday then that employee will be remunerated at double the normal rate of pay.

9. Annual Leave
The employee is entitled to 15 days paid leave after every 12 months of continuous service. Such leave is to be taken at times convenient to the employer’s business operations and agreed to ahead of time between both parties.

10. Sick leave
10.1 During every sick leave cycle of 36 months the employee will be entitled to an amount of paid sick leave equal to the number of days the employee would normally work during a period of six weeks.
10.2 During the first six months of employment the employee will entitled to one day’s paid sick leave for every 26 days worked.
10.3 The employee is to notify the employer as soon as possible in case of his/her absence from work through illness.

11. Maternity leave
11.1 The employee will be entitled to 4 months consecutive maternity leave.
11.2 The payment of maternity benefits is governed by the basic conditions of employment act.

12. Family responsibility leave
The employee will be entitled to three days family responsibility leave during each leave cycle.

13. Deductions from remuneration
The employer may not deduct any monies from the employee’s wage unless the employee has agreed to this in writing on each occasion.

14. Clothing
2 sets of uniforms will be supplied to the employee by the employer and will remain the property of the employer.

15. Notice period

One week for an employee who has worked for 6 months or less.

Two weeks for an employee who has worked for more than 6 months but not more than 1 year.

Four weeks for an employee who has worked for 1 year or more.


NOTICE – ALL EMPLOYEES ARE SUBJECTED TO THE FOLLOWING TESTS, POLYGRAPH TEST, ALCHOBLOW TEST AND A 5 IN 1 DRUG TEST. BY SIGNING THIS CONTRACT, YOU AGREE TO THE ABOVE MENTIONED.

Any changes to this agreement will only be valid if they are in writing and have been agreed and signed by both parties.
